One out of every twenty drivers drive regularly without insurance, therefore, it is not a surprising fact that one out of ten car accidents involve uninsured car drivers. It has generally been noticed that there are ten times more chances of uninsured drivers to drive drunk and there are three times more chances of them of being hit on the road due to driving without attention and care, and they are the ones who are mostly involved in hit and run type of incidents. On an average, they are hit on the road once after every 6 months.
In case of hitting an uninsured driver, you may not know that the driver is uninsured, so you have to react as per the normal way. You have to note the car’s make and model, along with its registration number. The other driver is not likely to give you his or her correct address, but whatever he or she tells you, just take a note of it, because it will give you a ground when you will claim for your compensation. Also do not forget to take a note about the damage caused to the other car and the scene of the accident. Taking a note of the road markings, weather conditions, light conditions, road signs and whether the car’s lights were or not, will also help you in your case of claim. If you are lucky enough to have some eye-witnesses of the accident, then do not forget to take their full address and other contact details. If you happen to carry a camera in your car, it is advisable to take a lot of photographs of the scene, car and if possible, the car driver. You can also do this with your mobile, if it has a camera. These can be of great help for the police and your attorney. It is also advisable to report to the police on the first hand, so that you are a report to submit in the court.
In case you are in a third party insurance, your insurance company will not pay for the repairs of your car, and as the other driver is also not insured, you will not get any claim from him unless you trace him in the court and win the case. In some places, there are rules against uninsured drivers, according to which the driver will be fined with certain penalty for even keeping a vehicle, and their car may be seized and even crushed.
*damages for loss of earnings and other losses and expenses are commonly paid in addition to the injury award and will vary in each case
