Child injury claims
We all know that children suffer injuries on a regular basis, usually their own fault and, fortunately, usually minor. However, ther are also many injuries suffered by children which are no fault of their own and where they may be entitled to claim compensation from a negligent party.
There are numerous situations where this can arise including :-
- Road accidents - as passenger, pedestrian, cyclist
- In the home - most accidents in the home will not be caused by a third party but this can arise eg. injury caused by defective products
- In public places - shops, cinemas, parks, restaurants etc
- At school - classroom, playground, gym, sports field, travelling to school,
- School activities - outings, trips excursions or holidays arranged by the school
Special considerations apply to claims involving children such as:
- In some situations a greater degree of care may be held to be required where children are concerned compared with adults. This could mean that negligence may be easier to establish.
- The three year time limit for bringing a claim differs for children in that the three year period does not commence until the eighteenth birthday (sixteenth in Scotland). Notwithstanding this, it is still essential to take legal advice as soon as possible after the accident so that full details can be obtained and evidence preserved.
- Persons under eighteen years of age are not able in law to bring an action in their own right and therefore an adult is appointed to protect the child's interests and to make decisions on their behalf.
