Wrongful Death Law

Wrongful deaths are on the rise in many countries and these are caused mainly due to the carelessness of some other person. The wrongful death law protects the victims and his family. Most of the countries now have laws for wrongful deaths. The person being held responsible for the death has to pay damages to the deceased’s family under the law. In most of the countries, the close family members like the wife, children and the parents can bring the case forth. It is possible that the victim or victims leave behind children. Basically, the dependents are the one who can bring up the case and receive the compensation from the other person whose wrongful acts lead to the death. It is not just that the death of a living person can be claimed for; expecting women can claim compensation for their foetus. The laws however may be different in various countries.

In the case of elderly people, the amount of compensation would be very less because the children of the person may be grown up and self supportive. In case, the person was still earning and has his wife and children still dependent upon him, the claim can be fully received. The person who is at fault may also vary from case to case. In a vehicular accident it may be the driver and in the case of death due to working conditions it has to be the employer. The family members cannot be sued for such a case, for example if a husband beats up his wife and leaves her dead, the children cannot claim any compensation. One needs to take care of the time for claiming the compensation as there is a time limit which can be for one to three years. If the case is not filed in this period, the case cannot be filed at all. Wrongful death law supports the dependents and assures them of a good financial life ahead.
