Wrongful Death Law

Wrongful deaths are caused due to the negligence of some other person. Wrongful death law enables the family members of victims to claim compensation for the deceased’s death. The Fatal Accidents Act 1976 is the relevant law in such claims. The person held responsible for the death is liable to pay damages to the deceased’s family under this law. The compensation is for the financial losses that the family has endured.

Close family members like the wife or husband, children and the parents of the victim can pursue claims. Dependents are able to receive compensation for the financial losses that have befallen them. Claims can cover the following: pain, suffering and loss of amenity of the victim, medical expenses, funeral expenses, dependency awards and bereavement awards. Pursuing such claims is essential for family members who are in financial difficulties.   

In the case of a victim who had family members dependant upon his/her earnings, the compensation amount is likely to be substantial. In the case of elderly people, the amount of compensation can be significantly less because their children will often be grown up and self supportive and they are unlikely to have other dependents. The person at fault can be an individual, an employer a medical professional or other persons.

If you wish to pursue a claim you should take care of the time limits for claiming compensation. The time limit in these cases is three years. If the case is not pursued in this period, the case cannot be pursued at all.
