Food Product Claims

Food product claims are claims made by manufacturers about their products regarding the qualities of the food. The claims can be about the weight loss capability of the food. Like, some manufacturers claim that their product is 100% fat free and by eating this product, a person can loss weight which is not true. Certain manufacturers also claim that their can-food products can reduce the risks of occurrence of certain diseases. These therapeutic food product claims are usually found to be false. The FDA continuously tries to administer whether the claims made by certain manufacturers are in adherence with their guidelines. The guidelines to a particular food product necessitate that certain rules should be followed while labelling and marketing the product. Many of such food product claims are found to be spurious and marketing gimmicks in order to make certain sections of the society eat the food product. Since the products cannot be proved unsafe for eating, hence it is difficult to take legal action against such false claims.

The manufacturers should try to be as truthful in their advertising as they can be and should try to manufacture such food products which do not cause adverse health consequences in consumers. This would increase the consumer confidence in their food products. If a certain food product harms a consumer, the manufacturer can be held responsible by the buyer under the product liability act. All the offences committed by the manufacturer in a particular food product are liable under the purview of the product liability act. In these kinds of cases, a consumer can sue the manufacturer and get adequate compensation for the harms he might have suffered as a result of the use of the product. For example, US government called back the beef products when it believed that the animals that were slaughtered for the meat were sick. So, the infection could pass on to people who would have eaten that meat. Under such law, government can also call back such product whose marketing overstate their benefits and does not warn the consumer against the possible risks that could result from the use of the product.

Sometimes, back a dangerous ingredient Diacetyl was found in butter popcorn that could have caused lung disease. The recipe of the microwave butter popcorn had to be changed to remove this ingredient. Sometimes processed foods can also be contaminated and lead to food poisoning in the eater. This can especially happen in the case of onions and spinach.
